1. Purpose and Legal Basis

These terms and conditions govern the use of all Fire & Ice Wellness Ltd facilities and services.

They incorporate the participation waiver and assumption of risk statement required under our insurance and operating procedures.

They have been prepared to comply with:

Unfair Contract Terms Act 1977 (UCTA) — Unfair Contract Terms Act 1977 (UCTA)
Consumer Rights Act 2015 — terms must be fair, transparent and not create a significant imbalance to the consumer's detriment.
Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 — customers booking online or by phone have specific cancellation rights.

2. Definitions

"We" / "our" / "the Business" — Fire & Ice Wellness Ltd, operating at Westbury Wildlife Park, Trym Road, Westbury-on-Trym, Bristol, BS9 3ET.
"You" / "the Participant" — any person who books, attends or uses our facilities, or on whose behalf a booking is made.
"Facilities" — the chlorinated cold water plunge pools, organic pool (natural water), wood-fired sauna, changing rooms, and all associated outdoor areas at Westbury Wildlife Park operated by Fire & Ice Wellness Ltd.
"Session" — a booked time slot during which you are entitled to use the Facilities.
"Voucher" — a gift voucher or credit note issued by Fire & Ice Wellness Ltd.

3. Booking and Payment

3.1 How to Book

Sessions must be booked in advance via our website at https://www.fireicewellness.co.uk/book-online or by contacting us directly. Walk-in access is not available without a prior booking.

3.2 Payment

Full payment is required at the time of booking unless otherwise agreed in writing. All prices are as displayed at the time of booking and include VAT where applicable.

3.3 Cancellation by You

For bookings made online or by telephone (distance contracts under the Consumer Contracts Regulations 2013):

You may cancel within 14 days of booking for a full refund, provided the Session has not yet taken place.
If you request that a Session takes place within the 14-day cooling-off period, you acknowledge that you lose your right to cancel once the Session begins.

Outside the 14-day cooling-off period:

Cancellations made more than 48 hours before the Session: full refund or reschedule at no additional charge.
Cancellations made less than 48 hours but more than 24 hours before the Session: no refund, but we will offer a reschedule at the same or equivalent price.
Cancellations made less than 24 hours before the Session, or non-attendance without prior notice: no refund and no reschedule.

3.4 Rescheduling

Requests to reschedule must be made at least 24 hours before your Session. Only one reschedule per booking is permitted. Rescheduled sessions are subject to availability.

3.5 Vouchers

Gift vouchers and credit notes issued by Fire & Ice Wellness Ltd are valid for 6 months from the date of issue. Vouchers cannot be exchanged for cash and are non-transferable unless otherwise stated in writing. Expired vouchers will not be extended or reissued except at our sole discretion.

3.6 Cancellation by Us

We may cancel or postpone a Session due to adverse weather conditions, unsafe site conditions, staff illness, equipment failure, or any other reason that we reasonably consider compromises the safety of participants. In such cases, you will receive a full refund or the option to reschedule at no additional cost. We will not be liable for any consequential losses arising from a cancellation by us.

4. Age Restriction

Fire & Ice Wellness facilities are available to persons aged 18 and over only. No exceptions will be made. Proof of age may be requested. Any person who is found to be under 18 will be refused entry and no refund will be given where false information has been provided at the time of booking.

5. Conditions of Entry and Use

5.1 Health Screening

Every participant must complete the Fire & Ice Wellness Health and Participation Form (FIW-18) before using any Facilities for the first time. This is a mandatory pre-screening requirement in line with BISHTA/SPATA Cold Water Immersion Industry Guidance. The form must be completed individually and cannot be completed on behalf of another person.

If you answer YES to any screening question, a member of staff will discuss your situation with you before you use any Facilities. We reserve the right to refuse participation where we reasonably believe that use of the Facilities would pose an unacceptable risk to your health or safety.

5.2 Fitness to Participate

You must not use the Facilities if you are, or appear to be, under the influence of alcohol or drugs. Our staff have the right to refuse entry or end your Session if they reasonably believe you are impaired. No refund will be given in these circumstances.

5.3 Safety Rules

You must comply with all safety rules, signage, and staff instructions at all times. Full safety rules are displayed on site. Key rules include:

Enter all water features slowly using steps and handholds provided.
No jumping, diving, or running on site.
No breath-holding competitions or prolonged submersion.
Observe maximum immersion durations as advised by staff for the current water temperature.
Exit the water immediately if you feel dizzy, faint, experience chest pain, difficulty breathing, or feel unwell. Alert staff immediately.
Do not touch or approach the sauna stove. Do not attempt to add fuel or water unless specifically instructed by staff.
Stay hydrated. Drink water before, during and after your Session.
Shower before entering any water facility.

Failure to follow safety rules may result in your Session being ended without refund.

6. Assumption of Risk

Cold water immersion, use of the organic pool, and wood-fired sauna use involve inherent risks that cannot be entirely eliminated, even with proper supervision, equipment and procedures. By participating, you acknowledge that you understand and voluntarily accept the following:

6.1 Cold Water Immersion (Chlorinated Plunge Pools)

Cold shock response, including involuntary gasp reflex and hyperventilation.
Cardiac stress and cardiac events.
Hypothermia during or after immersion.
Swimming failure or sudden incapacitation in the water.
Drowning.
Post-immersion collapse (which can occur after exiting the water, not only during immersion).
Exacerbation of pre-existing medical conditions.

6.2 Organic Pool (Natural, Unchlorinated Water)

In addition to the cold water immersion risks above:

Exposure to naturally occurring bacteria and micro-organisms not present in treated water, including leptospira (Weil's disease), E. coli, and other pathogens.
The organic pool is not chemically treated. Water quality is monitored and tested but cannot be guaranteed to meet the same safety standards as a chemically treated pool at all times.
Increased risk if you have open wounds, broken skin, or suppressed immune function.
Risk of delayed illness symptoms: if you develop flu-like symptoms, fever, muscle pain, or jaundice within 2 weeks of using the organic pool, you must seek urgent medical advice and inform your doctor of contact with natural water.

6.3 Wood-Fired Sauna

Extreme heat, heat stress, heat exhaustion, and heat stroke.
Dehydration.
Burns from contact with the stove, hot rocks, or hot sauna surfaces.
Fainting or loss of consciousness due to heat.
Steam burns if water is added to the rocks.
Exacerbation of cardiovascular, respiratory, and other pre-existing conditions.

6.4 Outdoor Wildlife Park Environment

Westbury Wildlife Park is an active wildlife park and natural outdoor environment. By visiting, you accept the following inherent environmental risks:

Uneven ground, tree roots, exposed surfaces, wet and slippery areas, and changes in ground level throughout the site.
Natural risk of falling branches, trees, or other vegetation, particularly during adverse weather conditions.
Insect activity including bee stings, wasp stings, and other biting insects native to the park environment.
Wildlife activity on and around the site.
Variable and changeable weather conditions including rain, wind, ice, and reduced visibility.
Reduced lighting at certain times of day or during evening sessions.
Wet surfaces in the vicinity of all water features.

You confirm that you have disclosed all relevant medical conditions on the Health and Participation Form and that the information you provided is accurate and complete.

7. Limitation of Liability

NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by law.

Subject to the above, and to the extent permitted by law:

We shall not be liable for any loss, injury, or damage arising from your failure to follow safety rules, staff instructions, or the conditions set out in these terms.
We shall not be liable for any loss, injury, or damage arising from your failure to disclose a relevant medical condition on the Health and Participation Form.
We shall not be liable for any loss of or damage to personal property brought onto the site, except where caused by our negligence.
We shall not be liable for any injury, illness, or damage arising from the inherent risks of the outdoor wildlife park environment described in Section 6.4.
Our total liability for any claim (other than for death or personal injury caused by negligence) shall not exceed the price paid for the Session giving rise to the claim.

NOTE: Under the Unfair Contract Terms Act 1977, a business cannot exclude liability for death or personal injury caused by negligence. A signed or acknowledged waiver does not prevent a claim where negligence is established. Its legal value is evidential — it demonstrates that the participant was informed of the risks, which is relevant to contributory negligence assessments.

8. Photography, Film and Data

Your personal data is processed in accordance with our Privacy Notice (FIW-21) and the UK General Data Protection Regulation (UK GDPR).

We may take photographs or video on site for promotional purposes. We will always request your consent before using images or footage of you in any marketing material. You may withdraw consent at any time by contacting us in writing.

You must not photograph or film other customers without their explicit consent.

9. Our Right to Refuse or End a Session

We reserve the right to refuse entry, end a Session early, or remove a person from the site without refund if:

They appear to be under the influence of alcohol or drugs.
They refuse to complete the Health and Participation Form or provide false or misleading information.
They fail to follow safety rules or staff instructions.
Their behaviour is aggressive, abusive, discriminatory, or threatens the safety or wellbeing of others.
They are under 18 years of age.
Site, weather, or safety conditions deteriorate to an unacceptable level.

10. Complaints

If you are unhappy with any aspect of your experience, please speak to a member of staff or the Site Lead on duty. If you wish to make a formal written complaint, please contact us via our website at www.fireicewellness.co.uk. Our full complaints procedure is set out in FIW-24.

11. Governing Law

These terms are governed by the laws of England and Wales. Any dispute arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
